Terms of Service for Grinta

1. Introduction
Welcome to Grinta. These Terms of Service (“Terms”) govern your access to and use of the Grinta application and associated services (collectively, the “Service”). Please read these Terms carefully before using the Service.
By downloading, installing, or using Grinta, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
2. Definitions
- “Grinta” refers to the productivity application described in these Terms.
- “Grinta Pro” refers to the premium version of the application with additional features.
- “User,” “you,” and “your” refer to any individual or entity using the Service.
- “We,” “us,” and “our” refer to the developers and operators of Grinta.
3. Use of the Service
3.1 Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.
3.2 Account Registration
The Service may be used without creating an account. However, certain features may require registration or payment in the future.
3.3 License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service for your personal, non-commercial use.

4.2 Grinta Pro Features
Grinta Pro includes additional AI-powered features such as:
- Notes Copilot
- Rephrase AI
- Inline AI
- Additional premium features as they may be added
5. User Content
5.1 Notes and Other User Content
You retain ownership of any content you create using the Service, including notes and other documents. However, you grant us a limited license to store, process, and display your content as necessary to provide the Service.
5.2 Storage of User Content
User content such as notes is stored locally on your device in the ~/Grinta/notes directory. We do not store your notes on our servers unless a backup or sync feature is specifically enabled.
5.3 Responsibility for User Content
You are solely responsible for all content you create, upload, or use in connection with the Service. You represent and warrant that you have all necessary rights to such content.
6. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use the Service. By using the Service, you agree to the collection and use of information as described in our Privacy Policy.
7. Intellectual Property Rights
7.1 Ownership
The Service and its original content (excluding User Content), features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.
7.2 Open Source Software
Grinta is an open-source application available under the terms of the license specified in our GitHub repository. Certain components may be licensed under different open-source licenses, which you agree to comply with.
8. Disclaimers
8.1 No Warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
8.2 Availability
We do not guarantee that the Service will be available at all times or that it will be uninterrupted or error-free.
8.3 AI-Generated Content
For Grinta Pro users, AI-generated content provided by features such as Notes Copilot, Rephrase AI, and Inline AI is created algorithmically and may not always be accurate, complete, or appropriate. You are responsible for reviewing and editing all AI-generated content.
9. Limitation of Liability
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
- ANY CONTENT OBTAINED FROM THE SERVICE
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
10. Modifications to the Service
10.1 Updates and Changes
We reserve the right to modify, suspend, or discontinue the Service, temporarily or permanently, at any time without notice. You agree that we will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
10.2 Changes to Terms
We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use the Service after those revisions become effective, you agree to be bound by the revised Terms.
11. Termination
11.1 Termination by You
You may stop using the Service at any time. You may uninstall the application from your device at any time.
11.2 Termination by Us
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
11.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
13. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall be resolved through good faith negotiations. If such negotiations fail, the dispute shall be submitted to binding arbitration in accordance with the rules of Polish Arbitration Association.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
